ITeC Academy Terms and Conditions

    1. Compliance with ITeC Academy policies and procedures
    All students agree to comply with the policies of ITeC Academy (and IRT Group), as published on the website and detailed in the Student Handbook, as well as all course requirements, requests for information and written instructions provided through course materials and official communications.

    2. Enrolment and Fees
    All course fees must be paid prior to course commencement.
    Students who have not paid their course fees—excluding those with an agreed and up-to-date payment plan—will not be permitted access to the ITeC Academy student portal, classroom, or virtual sessions.
    Refunds may be given in specific situations as outlined in the Fees and Refunds policy.

    3. Course Requirements
    Students must complete an online Language, Literacy, Numeracy, and Digital Skills assessment prior to enrolment in full qualifications.
    Students under the age of 18 require parent/guardian consent to enrol.
    Students must comply with technology and technical requirements for online components of courses.

    4. Attendance
    80% attendance is required for full qualifications.
    100% attendance is required for short courses.
    *does not apply to students undertaking an approved self-directed learning pathway.

    5. Work Placement
    Students participating in work placement where additional requirements apply such as a clear criminal history check, disability worker screening and/or immunisation will comply with all requirements.

    6. Assessment
    Assessments may involve a range of activities such as workplace-based projects, in-class projects, observations and role-plays, simulations, knowledge evidence, questionnaires, and online activities.
    Students will have a maximum of five attempts to resubmit assessments.

    7. Conduct
    Students must engage in online learning environments appropriately and follow the online code of conduct etiquette guidelines as specified in the Student Handbook.
    Plagiarism, cheating, and misuse of Artificial Intelligence are prohibited.

    8. Complaints and Appeals
    Students may lodge complaints in writing using the ITeC Academy Complaint Form.
    Appeals of assessment decisions must be made in writing within ten business days of the decision.

    9. Privacy and Confidentiality
    Student information will not be provided to anyone unless written consent is given or required by law.

    10. Student Responsibilities

    • Students must act with integrity and respect at all times.
    • Students agree to submit assessment evidence in line with agreed Training Plans and/or communicate requirements to apply for a short-term (e.g. up to one week) extension at least 48 hours before the due date. The Trainer/Assessor will approve or decline the request. Whereby an extension request, changes the course end date, trainers must first seek secondary approval from their manager, prior to confirming the final decision with the student.
    • Students should not make any unauthorised changes or updates to Assessor Feedback or marking.
    • Students must submit only work that is their own or that properly acknowledges the ideas, interpretations, words, or creative works of others.
    • Students may use Turnitin to check for similarity to others’ work including AI where appropriate.
    • Students must avoid lending original work to others for any reason.
    • Students should be clear about assessment conditions and seek clarification if in doubt.
    • Students must be clear about what is appropriate referencing and the consequences of inappropriate referencing.
    • Students should discourage others from plagiarising by observing the practices above.

    11. Data Protection
    ITeC Academy is committed to maintaining your privacy and confidentiality and complying with the NSW Privacy and Personal Information Protection Act 1998 and the Federal Privacy Act 1988. Student information will not be provided to anyone unless you have provided written consent for us to do so, or the information is allowed or required by law to be provided. This may occur when training attracts Government subsidies and may include Federal and State Education Departments, Trainee employers, and Australia Skills Quality Authority. Under the Data Provision Requirements 2012, ITeC Academy is required to collect personal information such as your name, Unique Student Identifier, date of birth, contact details, training outcomes and performance, sensitive personal information (including ethnicity or health information), and other enrolment and training activity-related information. This information may be disclosed to the National Centre for Vocational Education Research Ltd (NCVER) and other authorised agencies for statistical, regulatory, and research purposes. Your personal information may be used or disclosed for purposes such as issuing a VET Statement of Attainment or VET Qualification, facilitating statistics and research relating to education, understanding how the VET market operates, and administering VET programs. NCVER will collect, hold, use, and disclose your personal information in accordance with the Privacy Act 1988 (Cth.), the National VET Data Policy, and all NCVER policies and protocols.

    12. Recognition of Prior Learning and Credit Transfer
    ITeC Academy offers flexible learning options to meet the individual needs of each student within its resourcing capacity. Students may have their prior learning and experience assessed against specific units of competency within ITeC Academy’s registered scope. ITeC Academy recognises AQF qualifications and statements of attainment issued by other Registered Training Organisations, in line with the requirements of the relevant Training Package Qualification on its scope. All students are informed about the opportunity to have prior learning and AQF credentials recognised. (Refer to Credit Transfer and Recognition Policy).

    13. Privacy Notice & Applicant Declaration – Consent to Use and Disclosure of Personal Information – Subsidised Training in NSW Student Only.

    13.1 Why we collect your personal information
    As a registered training organisation (RTO), we collect your personal information so we can process and manage your enrolment in a vocational education and training (VET) course with us.

    13.2 How we use your personal information
    We use your personal information to enable us to deliver VET courses to you, and otherwise, as needed, to comply with our obligations as an RTO.

    13.3 How we disclose your personal information
    We are required by law (under the National Vocational Education and Training Regulator Act 2011 (Compilation 14 October 2024) (Cth) (NVETR Act) and Data Provision Requirements Instrument 2020, to disclose the personal information we collect about you to the National VET Data Collection kept by the National Centre for Vocational Education Research Ltd (NCVER). The NCVER is responsible for collecting, managing, analysing, and communicating research and statistics about the Australian VET sector. We are also authorised by law (under the NVETR Act) to disclose your personal information to the relevant state or territory training authority.

    Under the National Vocational Education and Training Regulator (Data Provision Requirements) Instrument 2020, ITeC Academy is required to collect personal information (information or an opinion about me), collected from me, my parent or guardian, such as my name, Unique Student Identifier, date of birth, contact details, training outcomes and performance, sensitive personal information (including my ethnicity or health information) and other enrolment and training activity-related information (together Personal Information) and disclose that Personal Information to the National Centre for Vocational Education Research Ltd (NCVER).

    Your Personal Information (including the personal information contained on your enrolment form and your training activity data) may be used or disclosed by ITeC Academy for statistical, regulatory and research purposes.

    ITeC Academy may disclose your personal information for these purposes to third parties, including:

    • School – if I am a secondary student undertaking VET, including a school-based apprenticeship or traineeship;
    • Employer – if I am enrolled in training paid by my employer;
    • Commonwealth and State or Territory government departments and authorised agencies,
    • including the NSW Department of Education (Department);
    • NCVER;
    • Organisations (including the Department) conducting student surveys; and
    • Researchers

    14. How the NCVER and other bodies handle your personal information
    Personal Information disclosed to NCVER may be used or disclosed for the following purposes:

    • issuing a VET Statement of Attainment or VET Qualification, and populating Authenticated VET
    • Transcripts;
    • facilitating statistics and research relating to education, including surveys;
    • understanding how the VET market operates, for policy, workforce planning and consumer
    • information; and
    • administering VET, including program administration, regulation, monitoring and evaluation.
    • I may receive an NCVER student survey which may be administered by an NCVER employee,
    • agent or third-party contractor. I may opt out of the survey at the time of being contacted.

    NCVER will collect, hold, use and disclose your Personal Information in accordance with the Privacy Act 1988 (Cth), the VET Data Policy and all NCVER policies and protocols (including those published on NCVER’s website at www.ncver.edu.au).

    The Department may disclose your Personal Information to other Australian government agencies, including those located in States and Territories outside New South Wales.

    The above government agencies may use my Personal Information for any purpose relating to the exercise of their government functions, including but not limited to the evaluation and assessment of my training, the determination of my eligibility to receive subsidised training or for any Fee Exemptions or Concessions. My Personal Information may also be disclosed to other third parties if required by law.

    15. How will ITeC Academy handle your personal information
    ITeC Academy is authorised by law, including the Privacy Act and the NVETR Act, to collect, use and disclose your personal information to fulfil specified functions and activities.     ITeC Academy retains a record of personal information about all individuals with whom we undertake any form of business activity. ITeC Academy must collect, hold, use, and disclose information from our clients and stakeholders for a range of purposes.

    As a government registered training organisation, regulated by the Australian Skills Quality Authority, ITeC Academy is required to collect, hold, use, and disclose a wide range of personal and sensitive information on Students in nationally recognised training programs. This information requirement is outlined in the National Vocational Education and Training Regulator Act 2011 and associated legislative instruments.

    ITeC Academy must require and confirm identification, however, in services delivery to individuals for nationally recognised course programs we are authorised by Australian law to deal only with individuals who have appropriately identified themselves. That is, it is a Condition of Registration for all RTOs under the National Vocational Education and Training Regulator Act 2011 (Compilation 14 October 2024) that we identify individuals and their specific individual needs on commencement of services delivery and collect and disclose Australian Vocational Education and Training Management of Information Statistical Standard (AVETMISS) data on all individuals enrolled in nationally recognised training programs.

    This Privacy Policy contains information about how individuals may access and seek correction of the personal information held by us, and how to complain about a breach of privacy, and how we will deal with such a complaint.

    16. Surveys
    You may receive a student survey which may be run by a government department or an NCVER employee, agent, third-party contractor, or another authorised agency. Please note you may opt out of the survey at the time of being contacted.

    17. Subsidised Training – ACT Students Only

    18. Unique Student Identified (USI) Privacy Note
    From 1 January 2015, ITeC Academy can be prevented from issuing you with a nationally recognised VET qualification or statement of attainment when you complete your course if you do not have a Unique Student Identifier (USI). In addition, we are required to include your USI in the data we submit to NCVER. If you have not yet obtained a USI, you can apply for it directly at https://www.usi.gov.au/students/create-your-usi on computer or mobile device.

    If you would like ITeC Academy to apply for a USI on your behalf you must authorise us to do so and declare that you have read the privacy information at https://www.usi.gov.au/documents/privacy-notice-when-rto-applies-their-behalf. You must also provide some additional information below so that we can apply for a USI on your behalf.

    In accordance with section 10 of the Student Identifiers Act 2014 (Compilation, 10 June 2025), ITeC Academy will securely destroy personal information which we collect from individuals solely for the purpose of applying for a USI on their behalf as soon as practicable after we have made the application, or the information is no longer needed for that purpose.
